Terms of Service

1. Who We Are and What We Do

Predictye provides forward-looking price intelligence: estimates of what physical assets (electronics, furniture, jewelry, watches, vehicles, appliances, collectibles, home & storage items, and general goods), real property, and rental markets may be worth now or at a future date, based on available market data and modeling.

Predictye is a decision-support and information tool. It is not a marketplace, broker, appraiser, lender, or financial advisor, and it does not buy, sell, list, or facilitate transactions in any item, property, or security. Any links or routing to third-party stores, marketplaces, or listing sites are provided for convenience only; Predictye is not a party to, and assumes no responsibility for, any transaction you complete elsewhere.

2. Eligibility and Accounts

You must be at least 18 years old (or the age of legal majority in your jurisdiction) to create an account or use the Service. By creating an account, you represent that the information you provide is accurate and that you will keep it up to date.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at support@predictye.com if you suspect unauthorized access.

We support account creation and sign-in through Predictye's own credential system as well as select third-party identity providers (such as Google and others we may add). If you sign in through a third-party provider, that provider's own terms and privacy practices also apply to your use of their sign-in service.

3. Estimates, Not Guarantees

This is the most important section of these Terms. Please read it carefully.

All valuations, forward price estimates, trend projections, "buy/sell/rent/wait" recommendations, and related outputs generated by the Service (collectively, "Estimates") are:

• Statistical estimates derived from available market data, not appraisals, guarantees, offers, or promises of actual value, actual sale price, or actual future performance;
• Inherently uncertain and may be inaccurate, particularly for items, locations, or time horizons where underlying market data is sparse, stale, or unrepresentative;
• Not a substitute for professional appraisal, inspection, legal, tax, insurance, or financial advice. For high-value decisions (large purchases, loans, insurance claims, legal disputes, tax filings, or formal appraisals), consult a licensed, qualified professional.

Predictye does not guarantee that any item will sell, rent, or be purchased at, near, or above any Estimate shown, nor that any projected future value will be realized. Market conditions, item condition, timing, negotiation, and factors outside our data change actual outcomes.

You are solely responsible for any decision you make — to buy, sell, rent, hold, finance, or otherwise act — based in whole or in part on information from the Service.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation;
• Attempt to reverse-engineer, scrape at scale, or extract the underlying data, models, or algorithms behind the Service except through a public API we provide (if any) and subject to its own rate limits and terms;
• Misrepresent Estimates from the Service as official appraisals, guaranteed valuations, or professional advice when communicating with third parties (e.g., insurers, lenders, or buyers);
• Interfere with, disrupt, or attempt to gain unauthorized access to the Service, its servers, or related systems;
• Upload content that is unlawful, infringing, fraudulent, or that you do not have the right to share (including photos of items you do not own or have permission to value).

We may suspend or terminate access for any account that violates these Terms.

5. Your Content

When you upload photos, descriptions, or other information about an item or property ("User Content"), you grant Predictye a non-exclusive, worldwide, royalty-free license to use, process, and store that content to provide and improve the Service, including to generate Estimates and, where you have separately agreed (such as through "Mark as Sold" outcome reporting), to contribute anonymized or aggregated data to our pricing database.

You represent that you have the right to submit your User Content and that it does not infringe any third party's rights.

6. Intellectual Property

The Service, including its software, design, text, graphics, trademarks ("Predictye," our logo, and related marks), and the compiled output of our models (excluding your own User Content), is owned by Predictye or our licensors and protected by intellectual property law. These Terms do not grant you any right to use our trademarks, branding, or proprietary data except as expressly permitted (for example, through an embeddable widget or public API we make available, subject to their own usage terms).

7. Third-Party Services and Links

The Service may link to, route to, or integrate with third-party websites, marketplaces, data providers, or sign-in services. We do not control and are not responsible for the content, accuracy, availability, or practices of any third-party service. Your use of any third-party service is governed by that party's own terms.

8. Disclaimers

The Service and all Estimates are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any Estimate will be accurate or that any outcome will match any Estimate.

9. Limitation of Liability

To the maximum extent permitted by law, Predictye and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from or related to your use of the Service or reliance on any Estimate, even if we have been advised of the possibility of such damages.

To the maximum extent permitted by law, our total liability for any claim arising from these Terms or the Service will not exceed the greater of (a) the amount you paid us, if any, in the twelve months before the claim arose, or (b) one hundred U.S. dollars ($100).

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

10. Indemnification

You agree to indemnify and hold Predictye harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your violation of these Terms, your User Content, or your use of the Service.

11. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to other users, us, or third parties.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Effective date" above and, where appropriate, provide additional notice (such as an in-app notice or email). Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws principles, except as superseded by applicable federal law.
